Castro customers loyalty program regulations

Loyalty program for the customers of Castro marketing 1985 Ltd. (hereinafter: "The program" and "Castro" respectively) is designated for Castro customers interested in being members of the program, subject to the instructions of these regulations (hereinafter: "The regulations").

The loyalty program is valid in Castro stores, Castro men and Castro Shoes & Bags in Israel only, and is not valid in Castro outlet stores (hereinafter: "Castro stores").

  • 1. Membership in the program
  • 1.1 A member in the loyalty program is who joined the program, and paid membership fees according to the regulations instructions (hereinafter:"Member in the loyalty program"). 
  • 1.2 Joining the program is involved in payment of annual membership fees of 80 NIS (hereinafter::"Membership fees"). The payment will be charged upon joining. Castro reserves the right to update, from time to time, the membership fees, to increase or reduce it, according to its sole discretion, without prior notice. For the removal of doubt, in case a member has joined the program and has paid membership fees and the membership have later been reduced, the member shall not be entitled to any refund and/or discount  for the membership already paid.
  • 1.3 The membership in the program is purchased for the period of 12 months. On the end of the membership, the member shall be entitled to renew his membership for an additional period of 12 months, by paying renewal fees as will be customary in Castro on the time of renewal. It is clarified that upon renewal of membership, the member will be subject to the regulations valid version on the time of renewal and that on time of renewal of membership, the program benefits may differ from those existing on the first time of joining the program.
  • 1.4 As a condition to membership in the program the member undertakes to fill a joining form to the program and in which to give to the company his full personal details. The member undertakes to give at least the following details: surname, family name, ID number, date of birth and contact means by at least one of the following: mobile phone number and/or  postal address and/or e-mail address (all together hereinafter: "contact details").

The member confirms he knows that filling the contact details on the joining form clearly and readably is a condition to membership in the program and the company shall be entitled, according to its discretion, to refuse to accept a member to the program in case he has not given the company the contact details and/or given in part and/or given unclear or unreadable. 

The member confirms the details he will give Castro are correct and complete and he confirms he will update Castro regarding any change in these details. 

  • 1.5 A member will be considered to have agreed on his free will that his name and details, as given by him upon joining the program, and also any information that accumulates in regards of the program and/or the member's purchases in Castro stores and/or any data that will be issued based on analyzing the above information and data, will be forwarded to Castro and will be used by Castro for promoting its actions, performance of information analyzing and statistic research and for direct mail to the members of the program, so that the use of the above information shall not be considered as invasion of privacy and will not grant the member any remedy and/or compensation. The said information will also be considered as Castro's property and the member hereby waives any claim regarding the  use of the information as above, including claim under the Law for protection of privacy, 1981. The club is entitled to forward the above information to factors on its behalf for performing the uses mentioned in this clause.
  • 1.6 Castro shall not be responsible for not receiving mail and/or anything regarding the program due to a fault and/or mistake and/or loss and/or not fulfilling and/or updating the personal details of the member.
  • 1.7 People whose age is not over 18 ("minors") who request to be accepted as members in the program, are required to inform their parents and/or their legal guardians ("parents") regarding the instructions of these regulations and accept their approval for performing every activity, of any kind, within the program. The parents are responsible to inform the minors who are interested in membership in the program regarding the regulations and also to supervise the minors' activity so that the minors will act according to these regulations. Any activity that will be carried out by the minors within the program of Castro constitutes agreement of the minors and/or the parents to what is said in the provisions of the regulations.
  • 1.8 Membership is for singles only (as opposed to corporations, agents and businesses), and the membership, including any right deriving from it and including any benefit given by the membership is personal and not transferable.
  • 1.9 Castro reserves the right to refuse to accept any member to the program, according to its sole discretion.
  • 1.10 Castro reserves the right not to approve joining and/or extension of membership in the program and/or instruct stopping of membership according to its sole discretion without any obligation to explain it.
  • 2 Benefits of the program
  • 2.1 Collection of Castro points
    • 2.1.1 On making a purchase in Castro stores according to the instructions of the regulations and also, on purchasing on Castro website (www. (hereinafter: "The website" or "Castro website" as the case may be) and subject to the provisions of the website regulations, the member shall be entitled to collect Castro points, all as detailed in these regulations.
    • 2.1.2 For every purchase, in one of Castro stores and/or the website, Castro points will be collected in favor of the member in the value of 10% from the purchase amount.
    • 2.1.3 Collecting the points will only be made on the following cases:

-Payment for items in cash and/or cheque and/or credit card, as long as it is paid.

-Payment by credit voucher and/or chargeable magnetic card (issued by Castro).

  • 2.1.4 For the removal of doubt, in the following cases there will not be points collection:

-Wish you card purchase chargeable magnetic card  (collection of the points will be made only upon exercising the magnetic card).

-Payments for items by gift vouchers and "gift cards" whatsoever, excluding Rav tav, Tav hazahav and Israel tav.

    • 2.1.5 Collection of the points is personal to any member and member and is  not transferable to another member or to a union of a few members. It is clarified for the removal of doubt that membership in CU program is not shareable and/or transferable and also cannot be used by anyone else but by CU member himself.
    • 2.1.6 Collection of points be made on purchase time only (on Castro store and/or Castro website)and is the responsibility of the member only and subject to identification on purchase time. No retroactive collection shall be possible. It is clarified that on purchase on a store collection will not be possible without presenting the membership card on purchase time.
  • 2.2 Utilization of Castro points
    • 2.2.1 A member can use The Castro points at his disposal at any time, as long as his membership is valid, at a ratio of 1 Castro point = 1 NIS, and to purchase by Castro points products in Castro stores as defined in the regulations. In case membership has expired and not been renewed,  the member will not be able to use the balance of points collected in his favor.
    • 2.2.2 It is possible to pay for items in Castro points, once you have reached a number of points equal to  the price of the item in the store only (it is not possible to add money or other payment means to points to reach the item's price). It is clarified it will not be possible to utilize collected points in the website, but in the stores only.  
    • 2.2.3 In any case Castro points cannot be converted to Israeli money or any other currency or credit voucher.
    • 2.2.4 Utilization of Castro points is conditional upon presenting an ID of the card owner in the store's cash box.
    • 2.2.5 Castro points can be used starting from the first purchase after the purchase on which those points were collected. 
    • 2.2.6 Inquiry of the balance of Castro points collected in favor of a member can be done in Castro stores, on Castro customer service center or in Castro website. It is clarified that updating the number of Castro points in Castro website is not done immediately and decreasing and/ or adding points regarding the points collected for a member will be done within 72 hours from the time of collecting or using the points. It is clarified for the removal of doubt that the number of points showing on the website is only an estimate and is not obligating Castro and that the up-to-date correct number of points is the one showing on Castro database.     • 2.2.7 In case a member has used more points than what is collected in his favor due to a fault or disruption in the computerized cash boxes in Castro stores and/or website the net is entitle to demand from the customer a financial refund in the value of 1 NIS per point as to cover the points deficit.
    • 2.2.8 Points cannot be used for the purchase of Castro gift and/or wish you card.
  • 2.3 Additional benefits
    • 2.3.1 A member will be entitled to a birthday benefit on his birthday. The benefit will be changed from time to time according to Castro's sole discretion.
  • 2.4 Credits and replacements
    • 2.4.1 Credits, returns and replacements of items purchase by Castro points will be done according to Castro returns and replacements procedures as updated from time to time according to Castro's sole discretion and subject to The Regulations of consumer protection (cancellation of transaction),2010.
    • 2.4.2 It is clarified that with the return of an item points were collected for, the following procedure shall apply:

-In case the return of the item will be credited in cash and/or credit card and/or cheque,  all according to the company's procedures, the points collected for the returned item will be offset from the account of the returner of the item, as much as he is a member. 

-In case the return of the item will be credited by Castro cheque, the points collected for the returned item will be offset from the account of the returner of the item, as much as he is a member, and against the issue of the Castro cheque the member will be credited in points in the offset amount.

-In case the item is returned against refund of the pay paid for it and in the circumstances where the points collected for the returned item have been utilized, and additional item/s has/have been purchased by them (hereinafter: "The utilized items"), then against the refund of pay for the returned item the utilized items will be returned as well and if used, their worth will be paid for.

    • 3 Newsletters
  • 3.1 CU members are entitled to receive information through various newsletters, including electronic newsletter, text messages and/or any other lawful way and/or approved by the member. Today our joining form does not request to mark approval for accepting newsletters but requests to mark who does not want to accept newsletters/ text messages/Israeli post – I have only written this to make sure it is compatible with what is written.
  • 4 Renewal/ cancellation/ expiry of membership in the program
  • 4.1 Every member shall be entitled to cancel his membership in the program subject to the provisions detailed in the instructions of The Regulations of consumer protection (cancellation of transaction),2010. Upon cancellation of membership points collected for the customer's card will be automatically deleted.
  • 4.2 Castro reservrs the right to cancel membership in the program, inter alia under circumstances when there is actual suspicion the member has committed an act of theft, deceit, fraud and/or any other case when, according to Castro's sole discretion, the customer has done something against the instructions of these regulations and/or that is to harm the business and/or reputation of Castro and/or the member acted unfairly to use the benefits granted to the members of the program according the instructions of these regulations and/or misused the member card granted to him.
  • 5 General
  • 5.1 These regulations is a condition to join the program and any member is deemed to have read and agreed to the instructions of these regulations, including any future change to it. Castro reserves its right to change and/or update and/or amend the instructions of these regulations, for all its clauses and/or part of them, including instructions for joining the program, program period, method of collection of Castro points, type of benefits etc., all as it find suitable and according to its sole discretion and without prior notice. The obligating vesion of the regulations will be published and updated from time to time according to need at Castro offices and Castro's internet website, and can be perused at in Castro stores. A member will not have any demand and/or claim regarding the provisions of the regulations and/or changes. Castro reserves to itself the right to change or end the program activity at any time.
  • 5.2 One shall not use the trademarks, contents, names, graphic designs and contents, music, files, pictures, photos, videos, words and marks showing on the Castro internet website and/or messages and publications of the program and/or newsletters of the program, and/or any other marketing and/or commercial material of the program ("contents"), for purposes which are not personal and non-commercial. One shall not copy, use, present, dispatch or allow others to do any of the above mentioned actions regarding the contents in any way, including inter alia in internet sites, publications of any sort and kind whatsoever, etc.
  • 5.3 These regulations are subject to the Israeli Law and jurisdiction regarding their application will be of the authorized court in Tel Aviv only and of no other court.
